2. Acceptance of Terms

By downloading, installing, or using the Tiny-SMS application or any associated services, you agree to be bound by these Terms of Service. If you do not agree, do not use the software or services.

These terms apply to all users including personal (free) users and commercial licence holders.

3. Licence

Personal Use — Free

The Tiny-SMS application is free for personal and non-commercial use under the terms of our dual licence. You may download, install, and use the app on your own devices for personal purposes at no charge.

Commercial Use — Paid Licence Required

Use of Tiny-SMS by any business, government department, public sector body, charity with paid staff, or educational institution requires a paid commercial licence. Use without a valid licence constitutes a breach of these terms and our licence agreement.

Commercial licences are available at the rates published on our pricing page. Licences are non-transferable unless agreed in writing.

Restrictions

  • You may not remove or obscure the Wallisoft / tiny-web.uk attribution from the app
  • You may not sublicense, sell, or resell the software without written agreement
  • You may not use the software for unlawful purposes or to send unsolicited messages
  • You may not attempt to reverse-engineer or circumvent licence enforcement

4. Payment and Billing

Commercial licences are billed via Stripe. By subscribing you authorise recurring charges at the published rate. You may cancel at any time via your Stripe billing portal — cancellation takes effect at the end of the current billing period.

Organisation and Enterprise licences are invoiced annually. Payment terms are 30 days from invoice date. Late payment may result in licence suspension.

5. Service and Availability

Tiny-SMS is provided as an Android application that runs on your own devices. We do not operate messaging infrastructure — messages are transmitted via your own Gmail account and your own Android device's SIM connection.

We do not guarantee uninterrupted operation. Availability depends on Google's Gmail API, your device's connectivity, and your SIM provider — factors outside our control.

We reserve the right to modify or discontinue the service with reasonable notice to licence holders.

6. Acceptable Use

You agree to use Tiny-SMS only for lawful purposes. You must not use the software to:

  • Send unsolicited commercial messages (spam)
  • Harass, threaten, or harm any individual
  • Impersonate any person or organisation
  • Violate any applicable law or regulation including GDPR and the Privacy and Electronic Communications Regulations
  • Facilitate any unlawful activity

We reserve the right to suspend or terminate licences for violation of this policy without refund.

7. Data and Privacy

Tiny-SMS is designed with privacy by architecture. Message content is transmitted directly between Google's Gmail servers and your Android device — Wallisoft does not receive, store, or process your message content.

We collect only the minimum data necessary to manage your licence (name, email, payment details via Stripe). See our Privacy Policy for full details.

8. Limitation of Liability

To the maximum extent permitted by law, Wallisoft shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of Tiny-SMS, including but not limited to loss of data, loss of business, or failure to deliver messages.

Our total liability to you shall not exceed the amount paid for your licence in the twelve months preceding the claim.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

9. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to These Terms

We may update these terms from time to time. We will notify commercial licence holders of material changes by email. Continued use of the software following notice of changes constitutes acceptance of the updated terms.
